What is conveyancing?
Conveyancing is the legal process of transferring ownership of a property from one person to another. It involves detailed legal searches, contract exchange, and completion to ensure a smooth, secure, and lawful transaction. We handle all the intricacies for you.
How long will my transaction take?
Property transactions vary, but we aim for efficiency. Typically, a freehold property takes 8-12 weeks, while leasehold can be longer, 12-16 weeks, due to additional complexities. We keep you informed every step of the way, providing realistic timelines and proactive updates.
The 5 stages of conveyancing involve
(1) instructing your solicitor, (2) investigating property title/searches, (3) exchanging contracts, (4) finalising funds for completion, (5) and post-completion registration.
Shall I get a property survey?
While not legally required, we strongly recommend a property survey. It can uncover hidden defects or issues that a standard mortgage valuation won't, potentially saving you significant costs and stress in the long run.
We do not advise on surveys or recommendations, your surveyor must provide specialist advice, and you need to deal with price negotiations with the seller directly via the estate agents, that is not a legal ,atter for lawyers.
What documents will I need to provide to my conveyancer?
You'll typically need proof of identity (e.g., passport/driving license) and address (e.g., recent utility bill), details of your mortgage lender, and property-specific information (e.g., Energy Performance Certificate, fittings and contents forms). We will provide a comprehensive checklist and guide you through collecting everything needed.
Are there hidden costs?
At JustConveySE, transparency is paramount. Our quotes are comprehensive and clearly itemise all fees, including disbursements. We strive to ensure there are no surprises, discussing any potential additional costs with you upfront before they arise.
What is the difference between freehold and leasehold?
Freehold means you own the property and the land it stands on outright. Leasehold means you own the property for a fixed period, but not the land, which is owned by the freeholder.
Leasehold properties often involve additional ground rent and service charges. We will explain in detail and confirm any additional charges, third party costs, and obligations.
When do I exchange contracts?
Exchanging contracts is the pivotal point at which the sale or purchase of the property becomes legally binding. Before this, either party can pull out without penalty. We'll ensure all necessary checks are complete and finances are in place before advising you to exchange.
DO NOT give notice if you are in rented accommodation until we confirm you should do so.
What happens on completion day?
Completion day is the exciting culmination of your property journey! It's when the remaining funds are transferred, and legal ownership officially passes to the buyer. Keys are then released, and you can move into your new home. We handle all the final legal and financial transfers to make it a smooth handover.
Then what....?
We then register the transaction at the Land Registry, and/or Companies House if you buy as a company, noting you and your lender on the title deeds.
